User Terms & Conditions

1. Application of these terms

(a) Scantek Solutions Pty Ltd (Scantek, we, us) is a technology company that provides identity verification products and services to its customers, including conveyancing organisations from time to time.
(b) The conveyancing organisation that you have engaged to provide conveyancing services to you (Conveyancer) has requested that you pay for the Verification Services that we provide to them, and which are required to complete your property.
(c) You agree to be bound by these terms and conditions (Terms) where you have been directed to pay for the Verification Services applicable to you.

2. Payment of Verification Services

(a) You must pay for the Verification Services by providing our online payments provider with details of your card, bank account or other payment method. You will be redirected to its payments platform to complete this process, and you will only be charged for the Transaction when you have submitted information for the Transaction Scantek does not store or have access to your payment information and this will be handled separately by our online payments provider in accordance with their policies and terms and conditions.

3. Transaction errors

(a) If you make an error when submitting information for the Transaction and the Transaction cannot be processed due to that error, the Conveyancer may correct that error on one occasion at no additional cost to you.
(b) However, if the Transaction fails to be processed successfully more than once due to your error, you agree that you will be required to re-submit information for the Transaction and we will charge you another transaction fee to re-process the Transaction as a result of your error.

4. Nature of relationship

(a) You acknowledge that we provide the Verification Services to the Conveyancer under a separate agreement between the Conveyancer and Scantek and your Conveyancer will receive your Transaction Result.
(b) Scantek is not providing the Verification Services to you and is only facilitating payment of the Verification Services by you on behalf of the Conveyancer in accordance with the instructions from the Conveyancer.

5. GST

Unless stated otherwise, all fees payable by you are inclusive of GST.

6. General

(a) Dispute resolution. In the event of any dispute under these Terms, the parties agree to negotiate in good faith to resolve the dispute.
(b) Severability. The invalidity or unenforceability of any provision of these Terms will not affect the rest of the provisions in these Terms, which will continue in full force and effect.
(c) Invalid or unenforceable provisions. If any part of these Terms are determined to be invalid or unenforceable pursuant to applicable law, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision, and the remainder of these Terms shall continue in full force and effect.
(d) No waiver. A provision of these Terms will not be taken to be waived except by written notice signed by us or you.
(e) Governing law and jurisdiction. The laws of Western Australia must be applied in construing these terms regardless of where it is executed or where the Verification Services are provided, and the parties submit to the non-exclusive jurisdiction of Western Australia.

7. Definitions

Conveyancer has the meaning given in clause 1(b). Transaction means a request for Verification Services and/or delivery of Verification Services. Transaction Result means the result of a Transaction provided by Scantek to the Conveyancer. Verification Services means the verification services provided by Scantek to the Conveyancer.
